Channel Epson Specific Terms of Use
INTRODUCTION
Epson Australia Pty Ltd ABN 91 002 625 783 of Level 7, 90 Arthur Street, North Sydney, NSW, 2060, Australia, ("Epson") owns and operates the Channel Epson website ("Site") for the exclusive use of companies, businesses or franchises with a business relationship with Epson, as described in the following 5 definitions ("Stores") as well as authorised advertising agencies, copywriters, web designers and graphic designers ("Service Providers"):
- Resellers:
Stores who purchase Epson products from an Epson Distributor and who resell them to the public.
- Distributors:
Stores who purchase products from Epson and sell them to Resellers.
- Dealers:
Stores with a direct purchasing arrangement with Epson and who resell to the public.
- Retailers:
Large retail or department Stores who purchase products directly from Epson and who sell them to the public.
- Authorised Repairers:
Organisations contracted by Epson to carry out warranty repairs on Epson's behalf and for this purpose to log warranty claims and order spare parts on this Site.
This Site is not for use by any person or organisation that does not fall within the above definitions of a Store, or a Service Provider (such as a Marketing Agency), and in particular is not for use by any member of the public.
By clicking the "Application Declaration" checkbox during registration for the Site, you agree on behalf of your Store or Service Provider to the following specific terms of use.
SITE ACCESS FOR STORES
To register your Store to use this Site you must be the Owner, Director or Authorised Manager of a Store ("Store Manager") that sells genuine Epson branded products.
To register your Store, the store owner, director or authorised manager must complete the registration page.
Upon verification of your Store details, Epson will e-mail the Store Manager confirmation that the account is active. The Store Manager may then authorise other Store employees to access the Site by add new store members via the My Account page. The Store Manager may also suspend or terminate a Store employee's access to the Site via the My Account / Edit Members page.
During the first login to the Site, a Store Manager may change its password so that all subsequent logins to the Site via the My Account / Change Password page.
SITE ACCESS FOR AUTHORISED REPAIRERS
Once an authorised repairer is appointed, Epson will register that repairer to use this Site and will allocate the Service Manager of that repairer via e-mail a password to access the Site. The Service Manager may then authorise other Store employees to access the Site by following the procedure on the Store Management page. The Service Manager may also suspend or terminate a Store employee's access to the Site by following the procedure set out on the Add/Edit Store Members page.
During the first login to the Site, a Service Manager may change its password so that all subsequent logins to the Site are by email address and user-created password.
TERMS OF SALE AND WARRANTY JOB PROCESSING
In addition to this standard set of website terms, a specific set of Terms and Conditions applies to Service Agents placing orders for New Products, Spare Parts, Factory Seconds and Warranty Job claims. More information click here.
SITE ACCESS FOR SERVICE PROVIDERS
Before a Service Provider or Marketing Agency can gain access to the Site, it must be authorised and allocated a login name and password.
CONFIDENTIALITY
You must preserve the confidentiality of your Site passwords and you must take reasonable steps to ensure that unauthorised users do not access the Site. You must promptly notify Epson of any known or suspected misuse of the Site or other breach of security.
PRIVACY
Details entered on the Site, such as the Store name, location, contact details and the Epson products sold by that Store.
Other information relating to the Store that is entered into the Site by a Store Manager or Store employees will be treated as confidential.

SITE USAGE
Epson authorises Stores and Service Providers to view and download product information ("Materials") from the Site, including
- Product Brochures
- Product Bulletins
- Catalogue Copy
- Logos and product images.
- Videos
- Whitepapers
Additionally, Authorised Repairers may view and download repair related information from the Site, including
- Technical Bulletins
- Administrative Bulletins
- Technical downloads
Epson grants Stores and Service Providers permission to incorporate Materials into a Store's sales or information brochures, on condition that the relevant Store and Service Provider will indemnify Epson against:
- Any customer action or claim arising from any error or omission made by it when incorporating Materials into sales or information brochures;
- Any misleading or deceptive statement made by a Store or Service Provider in relation to the Materials; and
- Any other inaccurate, misleading or deceptive use of the Materials by a Store or Service Provider.
If Epson designates any Materials as being confidential, a Store or Service Provider must not disclose them to anyone else without Epson's prior consent.
TRADEMARKS AND OWNERSHIP OF MATERIALS
All materials on the Site, including text, images, audio and video ("Materials") are copyright to Epson and must not be wholly or partly distributed, modified, reproduced or used beyond the use authorised on this site without Epson's prior written consent. You must comply with all copyright and other proprietary notices on the Site.
You acknowledge that "Epson" and the Epson logos are registered trademarks of Seiko Epson Corporation of Japan.
ELECTRONIC COMMUNICATIONS FROM Epson
Registered Store Managers or Service Providers will receive regular electronic communications from Epson relating to its products ("Commercial Electronic Messages") and you must maintain for this purpose a valid e-mail address. You agree that the Site will be Epson's main mode of communication with its Channel partners, and that all product brochures, pricelists, bulletins and price changes will be notified by electronic messaging instead of by hard copy.
By including your email address in your Store's or Service Provider's application to join the Site, you consent to all future Bulletins relating to Epson products being sent or made available to you by means of Commercial Electronic Messages.
All Epson's Commercial Electronic Messages will contain:
- Sufficient information to identify Epson as the source of that message; and
- An "unsubscribe" facility, allowing you to notify Epson that your Store does not wish to receive future commercial electronic messages.
By choosing to unsubscribe from Commercial Electronic Messages, a Store or Service Provider will lose the benefit of up to the minute information on Epson products and may not be able to properly represent Epson products.
Authorised Repairers agree to receive administrative and technical bulletins by e-mail, and to use this Site to log warranty work and order spare parts.
YOUR USE OF THE SITE
You agree that:
- You will not use the Site for any purpose that is unlawful or prohibited by these Terms of Use
- You will not use this Site to collect or store personal information about other Site users
- You will not try to gain unauthorised access to any part of the Site or to upload any virus, data or information that may corrupt or affect adversely the operation of the Site.
Epson reserves the right to terminate your account and/or cancel your access to the Site at our complete discretion, if we believe that you may be violating any applicable law or breaching these Terms of Use or otherwise acting detrimentally to our interests.
SUSPENSION AND TERMINATION
Epson has the right to suspend services through the Site and to suspend or terminate a Store's or Service Provider's access to the Site, if it believes that the Store, Store Manager, Service Provider or any employee has breached the Specific Terms Of Use of the Site or if Epson's Channel member relationship with a Store is terminated.
You have the right to suspend or terminate your Store's or Service Provider's access to or use of the Site by notifying Epson at any time, in which case Epson will disable your Store or Service Providers account.
THIRD PARTY COMPANIES, PRODUCTS AND WEBSITES
Any products manufactured by third parties ("Non Epson Products") or web sites operated by third parties ("Third Party Site") that are mentioned on this Site should not be taken as being endorsed or recommended by Epson.
Epson makes no representations or warranties regarding the quality, safety, performance or suitability of any Non Epson Products. You must order Non Epson Products directly from the relevant vendor and all consequential agreements and licences will bind you and the relevant vendor and will not involve Epson in any liability whatsoever.
Epson does not assert any proprietary rights to any Non Epson Products, or associated brand names or logos shown or mentioned on this Site.
If you use a link from this Site to a Third Party Site, you acknowledge that Epson has no responsibility for the material or information on that Site and that Epson has no liability arising from any transaction resulting from your link to a Third Party Site.
LIMITATION OF LIABILITY ARISING FROM SITE USE
Epson will use its best efforts to ensure that Materials on the Site are accurate, complete and promptly updated when required.
Epson will use its best efforts to ensure that the Site is functional, but does not warrant that the servers on which the Site is hosted are free of viruses and other harmful programs or components or that your use of the Site will be uninterrupted or error-free.
At your own cost, you must take whatever precautions you consider necessary to protect your computer system from viruses or any other components or programs, including (but without limitation) worms or 'Trojan horses', which may interfere with or damage your computer system while using the Site.
In particular, but without limitation, Epson will not be liable for
- Any damage to your computer system, or any corruption or loss of data arising from your use of the Site or downloading of Materials
- Any consequential loss that may result from your use of, or any inability to use, the Materials.
SOFTWARE DOWNLOADS
If you download software from the Site, your use of the Software will be governed by any Software License Agreement that accompanies the Software. Epson (or the relevant supplier) will retain full title to the Software and all associated intellectual property rights. You may not redistribute, sell, decompile, reverse engineer, or otherwise convert the Software to a human-readable form.
FEEDBACK AND INFORMATION
Any feedback you provide to Epson on this Site will be non-confidential and Epson will be free to use such information for any purpose.
UPDATE OF TERMS
Epson may change these Terms of Use at any time but will not give you separate notice of any changes. You should periodically review the current Website Terms to familiarise yourself with any revisions that will affect you.
GOVERNING LAW
The laws of New South Wales Australia govern these Terms of Use.
